La desigualdad de género es un problema de salud

En el centenario del establecimiento del Día Internacional de la Mujer (el 8 de marzo pasado), propuesto en la primera Conferencia Internacional de las Mujeres, realizada en Copenhague, en 1910, es oportuno hacer un balance de los avances y los retos en la lucha por la equidad de género. En las Américas, el avance de las mujeres en educación y acceso al mercado laboral no ha sido acompañado de igual manera en el ejercicio de sus derechos a la salud.
Las desigualdades de género son más lacerantes en las poblaciones vulnerables, como mujeres en situación de pobreza, indígenas, afrodescendientes, adolescentes y habitantes rurales. Una reciente publicación de la Organización Panamericana de la Salud (OPS) “La salud de las mujeres y los hombres en las Américas. Perfil 2009” y otra de la Organización Mundial de la Salud (OMS) “Las mujeres y la salud” reflejan el fuerte compromiso con la equidad de género expresado por su directora general, Margaret Chan, al asumir sus funciones.
En ambas publicaciones, se presenta evidencia que hace visible las desigualdades. La mortalidad materna permanece como un problema de salud evitable. En las Américas, la razón de mortalidad materna es de 63,7 por 100.000 nacidos vivos, rango que fluctúa entre el 8,8 en Canadá y 630 en Haití.
Pero se pueden corregir estas inequidades. Esto lo demuestran tres experiencias exitosas de buenas prácticas en salud, adolescencia y perspectiva de igualdad de género de El Salvador, Argentina y Brasil que fueron distinguidas por la OPS en el marco de su concurso regional y del que participaron 71 proyectos de 19 países. Las iniciativas destacadas demuestran que la mortalidad materna es menor cuando las mujeres tienen mayor acceso a métodos de planificación familiar

| Focusing on Intimate Partner Sexual Abuse: What Judges Can Do
For many years, owing to marital rape exemption laws on the books, intimate partner sexual abuse evaded legal recognition. Even now, 26 states have laws which provide for lesser penalties for perpetrators if they rape within the context of marriage.
While the legal system has historically overlooked or ignored the role of sexual abuse in violent relationships, Lynn Hecht Schafran, Director of Legal Momentum's National Judicial Education Program, points out that intimate partner sexual abuse is actually an important factor in determining the risks - to the victim, family members, and third parties -- posed by the perpetrator in this issue of Judicature Magazine.
Judges have a unique role to play in realizing the implications of intimate partner sexual assault and encouraging law enforcement, prosecutors, and victim's advocates to focus on this issue:
"Judges can enhance victim and comunity safety and educate the community by treating intimate partner sexual abuse with the seriousness it deserves. Judges can require that batterer intervention programs address intimate partner sexual abuse (many currently ignore it) and, in criminal cases, sentence offenders in accordance with the gravity of the crime and the unique impact on victims Both pre-sentence assessments and post-conviction assessments should probe for co-occurring physical and sexual abuse, even if this was not raised in this court, in order to determine whether sex offender treatment would be appropriate."

Fiscalia de Bolivia Rescata a Ninos Haitanos
La Paz. Fiscalía de Bolivia rescata a niños haitianos “Mamita estoy con hambre, no tengo comida, ven a llevarme”. Según una fiscal esas fueron las palabras de un niño haitiano rescatado en Santa Cruz, y que, gracias a una tercera persona, se comunicó telefónicamente con su madre. Era una de las víctimas de una presunta red de trata y tráfico de personas que tenía al menos 27 niños procedentes de Haití. La fiscal Pura Cuéllar informó a BBC Mundo que 19 niños fueron rescatados y están en un hogar del Estado. Y que aún está tras el rastro de otros 8 que están ocultos en algún lugar de Santa Cruz. Por orden de un juez, 3 personas fueron enviadas a prisión, entre ellos un hombre haitiano de nombre Dorvil, quien sería el líder de la red de tráfico, y 2 mujeres, una haitiana y otra boliviana. La última tenía en su poder a 3 muchachas adolescentes de Haití y no supo explicar por qué estaban con ella. Los detenidos están acusados de trata y tráfico de personas con fines de explotación sexual. Según la fiscal un niño contó que su padre recibió dinero, por lo que no se descarta que algunos hayan sido comprados, y otros hayan sido raptados. [Mery Vaca, BBC Mundo]

Repudia SC impunidad de militares
Exigen justicia por feminicidio en Ciudad Juárez

México, DF, 16 mar. 10 (CIMAC).- La sociedad civil en Ciudad Juárez, reiteró hoy la exigencia de justicia para las mujeres víctimas de feminicidio, y repudió la militarización de la entidad que se ha traducido en una escalada de agresiones contra la sociedad, asesinatos, ejecuciones y desapariciones por parte de los elementos del Ejército mexicano.
En el marco de la tercera visita de Felipe Calderón Hinojosa a la entidad, Olga Esparza y Patricia Cervantes, en representación de las hijas desaparecidas y asesinadas en Ciudad Juárez, refirieron que desde marzo de 2008, cuando inició el Operativo Conjunto Juárez, el Ejército ha reconocido 732 casos de abusos cometidos por militares.
Gustavo de la Rosa Hickerson, visitador de la Comisión Estatal de Derechos Humanos, recabó cerca de 200 denuncias de abusos de soldados, recién informó el Centro de Derechos Humanos Miguel Agustín Pro Juárez, en su informe Sociedad amenazada. Violencia e impunidad, rostros del México actual.

Feminist Law Prof Sarah Deer (William Mitchell) has posted to SSRN her article, “Relocation Revisited: Sex Trafficking of Native Women in the United States.” Here is the abstract:
The Trafficking Victim Protection Act of 2000 (TVPA) signaled a comprehensive campaign by the United States (US) government to address the scourge of human trafficking in the US and abroad. The US rhetoric about sex trafficking suggests that the problem originates in foreign countries and/or is recent problem. Neither claim is correct. This article details the historical and legal context of sex trafficking from its origin among the colonial predecessors of the US and documents the commercial trafficking of Native women over several centuries. Native women have experienced generations of enslavement, exploitation, exportation, and relocation. Human trafficking is not just a problem of poor, underdeveloped nations but an ongoing issue in the US and Canada that ties into the growth of the sex industry in these nations, where Native women are significantly overrepresented.

En Argentina, como en muchos otros países, la mayoría de los medios impresos tiene una sección de clasificados donde se ofrecen avisos de compra o venta de productos, y propiedades, oferta laborales y los llamados de 'servicios sexuales'. En muchas ocasiones -si no en la mayoría de ellas- estos últimos encubren una parte de la trama del negocio de la trata de personas.

Estoy investigando la Trata de Personas desde hace unos 3 años, sin haber podido hasta la fecha resolver el problema, pero encontrándome de frente con verdades de Perogrullo, por lo remanidas. Pero que había que corroborar.
Se engaña a las chicas, cada vez más jóvenes, capturándolas bajo engaños, o por la fuerza, luego obligándolas bajo amenaza, gritos, violencia, golpizas y drogándolas, a ejercer la prostitución para ingreso pecuniario de terceras personas.
Las ofrecen conocidos y conocidas de su entorno, a veces pensando que es por su bien o que en realidad sería una oportunidad de un trabajo “en serio”: mozas, ayudantes, nada.

1325 implementation – Where is Secretary-General’s leadership?

New York, March 8 — Exactly to the date, 10 years ago, on the International Women’s Day, on behalf of the UN Security Council as its President, I had the honor to issue a statement that brought to global attention the unrecognized, under-utilized and under-valued contribution women can make to preventing war, to building peace and to engaging individuals and societies live in harmony.
The members of the Security Council recognized that peace is inextricably linked with equality between women and men and affirmed the equal access and full participation of women in power structures and their full involvement in all efforts for peace and security.
It is unfortunate that the intrinsic role of women in global peace and security had remained unrecognized since the creation of the United Nations.
For a long time, there has been an impression of women as helpless victims
of wars and conflicts.
The role of women in fostering peace in their communities and beyond has
often been overlooked. The inexplicable silence of 55 long years was
broken, for the first time, on the 8th of March 2000. Thereby, the seed for the
Security Council resolution 1325 was sown.
If one looks into the relevance of contents, potential for change and
expected impact of any global declaration for women, two stand out head and
shoulder above all others.

UNITED NATIONS, Mar 12 (IPS/TerraViva) – When a two-week meeting on gender empowerment concluded at U.N. headquarters Friday, there were several lingering questions crying out for answers.
Were there any commitments to protect the universality of women’s rights, including sexual and reproductive rights?
Was there any significant progress on the proposal to set up a separate U.N. agency – officially called a gender entity – for women?
And were there any indications of increased funding for gender-related issues, including resources to battle sexual violence?
The answers were mostly in the realm of political uncertainty, as the U.N. Commission on the Status of Women (CSW) assessed the state of women’s rights, 15 years after the Fourth World Conference on Women in Beijing approved a wide-ranging plan of action on gender empowerment.
Naisola Likimani of the pan-African Femnet, an advocacy organisation, said she was emotionally exhausted from two weeks of nonstop meetings.
However, she said, it was good to see that certain issues were now understood – such as human trafficking, which was no longer seen as an emerging issue. It was now part of a global space that required attention.
