The Supreme Court has agreed to hear a case that could clarify the Sixth
Amendment's "confrontation clause." It may have implications for victims of
domestic violence.
Giles vs. California is an appeal brought by Dwayne Giles, a California man
accused of shooting and killing his former girlfriend, Brenda Avie. Several
weeks before the murder, Avie told police that Giles was threatening to kill
her. At issue is whether the police officer's testimony about what Avie told
him is admissible, since Giles cannot now face Avie in court to challenge
her claim that he was threatening her life.
This is not a new issue for the Supreme Court. Its 2004 decision in Crawford
v. Washington emphasized the right of defendants to confront a state's
witnesses. In that case, the Court ruled unanimously that statements from
witnesses who do not come to court and thus cannot be confronted by their
accusers should be excluded. It was, at that time, a significant change to
existing law.
The issue arose again in 2006, but the Court only partially answered it. At
that time, the New York Times reports, "Justice Scalia addressed concerns
that victims of domestic violence, who are often afraid to testify in court,
might suffer from such a rule. Defendants who 'seek to undermine the
judicial process by procuring or coercing silence from witnesses and
victims' would forfeit the protection of the confrontation clause."
"It is therefore likely that the justices accepted the new case, Giles v.
California, to make it clear that as long as the victim's unavailability as
a witness was a foreseeable consequence of the murder, the Sixth Amendment
does not require the state to prove the actual motive for the murder was to make the victim unavailable," the New York Times reports.
Giles vs. California is likely to be argued in April, with a ruling expected this summer.

I am a bilingual victim advocate working at Yavapai Family Advocacy Center in Prescott Valley, Arizona (Northern Arizona). We work with children and women that have been abused or sexual assaulted. I run the domestic violence program in Spanish and English. Afghan woman sells daughter for $10

KUNDUZ CITY (PAN): Poverty, cold weather, and hunger forced a woman to sell her four month baby in Kunduz.
Mahboba, 26, whose lower limbs are paralyzed is living in a dark muddy room in Sar- dara area of Kunduz city.
She told Pajhwok Afghan News while cooking in a muddy oven: "We have no food, my three children died due to cold weather; I was compelled to sell my four months old daughter only for 500 afghanis a day back to the owner of the house"
She said: "I begged every one and even the owner of the house did not
helped me and finally I had to sell my daughter"
Mahboba has two sons aged 9 and 10 years.
Sakhi, 9 said trembling with cold weather: "why did my mother sold my sister, I miss her"
Mahboba said her 40 year old husband is sick and is unable to work.
Muhammad Hassan, Mahboba's husband who could not speak properly said:
"there is not one in our country to help, let me die in helplessness"
He said no one would sell his children, but poverty and hunger made me sell my daughter.
Din Muhammad, owner of the house said three children of Muhammad Hassan had died, so he bought her daughter for rescuing her life.
He said: "I have paid them 500 afghanis to buy food; I will not take
the rent of the house and will provide food sometimes for them"
Din Muhammad did not comment when reporter asked him why he bought the girl instead of supporting the family without her.
Muhammad Zahir Zafari, Afghanistan Indpendent Human Rights Commission
regional officer in Kunduz said selling children is against the human rights and humiliation to mankind.
He said they will investigate why a mother was compelled to sell her daughter.
Eng. Muhammad Omar, Kunduz governor said the incident was painful and the government will try to support such families.
The governor said he will assign a commission to investigate the
particular case.

A young man, a student of journalism, is sentenced to death by an Islamic court for downloading a report from the internet. The sentence is then upheld by the country's rulers.
This is Afghanistan - not in Taliban times but six years after "liberation"
and under the democratic rule of the West's ally Hamid Karzai.
The fate of Sayed Pervez Kambaksh has led to domestic and international protests, and deepening concern about erosion of civil liberties in Afghanistan.
He was accused of blasphemy after he downloaded a report from a
Farsi website which stated that Muslim fundamentalists who claimed the Koran justified the oppression of women had misrepresented the views of the
prophet Mohamed.
Mr Kambaksh, 23, distributed the tract to fellow students and teachers at Balkh University with the aim, he said, of provoking a debate on the matter.
But a complaint was made against him and he was arrested, tried by religious judges without - say his friends and family - being allowed legal representation and sentenced to death.

Please help publicize the disappearance of 15 year old Adriana Sarmiento Enriquez. She is a friend of one of our Amigos. She disappeared on her way home from school on Friday, January 18th. She is fifteen, 55 kilos, 155 cm, has hazel eyes and long brown hair. She was last seen by her friend when they departed from a bus stop on their way home from eating after school. Adriana disappeared sometime on her walk from the bus stop to her home.

Abstract: This study examines the characteristics of sexual assault and sexual abuse of minor incidents reported to the Alaska State Troopers (AST), providing the first statewide overview of such cases. The sample utilized for the analysis included all sexual assault and sexual abuse of minor incidents reported from January 1, 2003 to December 31, 2004 and includes information from 989 reports, 1,903 charges, 1,050 suspects, 1,082 victims, and 771 witnesses. The descriptive analysis documents the characteristics of these reports, suspects, victims, incidents, and witnesses, and examines three legal resolutions: whether cases were referred for prosecution, whether cases were accepted for prosecution, and whether cases resulted in a conviction.

Le escribo para comincarles que José Rodríguez Salvador, el violador del Vall d'Hebrón,que salió en libertad de la cárcel de Quatre Camins, en La Roca del Vallès (Barcelona), después de haber pasado 16 años en prisión por 16 violaciones cometidas entre 1990 y 1991; está residiendo en la localidad Vallisoletana de Laguna de Duero.
Este individuo ha estado dos veces ingresado en la cárcel. En la primera había pasado siete años entre rejas por otra violación. A los 10 días de salir volvió a violar a una mujer.
Cuando le detuvieron y le juzgaron, en 1991, le acusaron de 40 violaciones, aunque la Audiencia de Barcelona sólo pudo probar 15. Posteriormente, una de sus víctimas le reconoció al verle por televisión y terminaron condenándole por 16 agresiones. Le cayeron 311 años.
Después de algunas reducciones de condena, Rodríguez Salvador vuelve hoy a la calle habiendo cumplido sólo un 5% de su pena.
Este individuo trás estar en un pueblo granadino de donde procede su familia, ha terminado a parar en la localidad vallisoletana de Laguna de Duero. Este sujeto no se ha rehabilitado, pues se negó a participar en las terapias de rehabilitación. Es un peligro latente, y es indignante que le hayan dejado salir de la carcel solo cumpliendo 16 años de los 300 a los que estaba condenados.
Laguna de Duero es uno las localidades con mayor población joven de toda España. Hay muchos niños y adolescentes viviendo en esta localidad, para el cual este sujeto es un peligro.
Le escribo para que difundan este mensaje y para que nos puedan aconsejar de como podemos actuar los vecinos de esta localidad atemorizados por la presencia de este individuo peligroso

| Centenares de personas se concentran en Madrid y Barcelona para exigir la despenalización del aborto
Centenares de personas (alrededor de 3.000, según las asociaciones feministas) se concentraron esta tarde en la Puerta del Sol de Madrid para reclamar al Ejecutivo la despenalización del aborto. Otras once ciudades españolas han acogido concentraciones similares, entre ellas Barcelona donde unas 350 personas se concentraron esta tarde en la plaza Sant Jaume a favor del aborto "libre y gratuito".
En el acto de la Puerta del Sol, convocado por 70 organizaciones feministas, se leyó un manifiesto en el que se criticaron las recientes actuaciones de la Guardia Civil y la personación en los domicilios de las mujeres para citarlas a declarar por la interrupción de su embarazo.
A su modo, estas intervenciones su suponen "una vulneración de su intimidad" y "la criminalización de las mujeres que han decidido abortar bajo los supuestos que establece la ley".
