Somalia: UNICEF speaks out against stoning death of 13-year-old rape victim
4 November 2008 – The United Nations Children’s Fund (UNICEF) has deplored last week’s stoning to death of a 13-year-old Somali girl who was a victim of rape.
Aisha Duhulow was stoned to death in a stadium full of spectators in the southern port city of Kismayo on 27 October after authorities found her guilty of adultery.
But reports indicate that she had been raped by three men while walking to visit her grandmother in the capital Mogadishu. After the attack, Aisha asked for protection from prosecutors, who in turn accused her of adultery and sentenced her to death.
“This is a tragic and deplorable incident,” said Christian Balslev-Olesen, UNICEF Representative for Somalia. “A child was victimized twice – first by the perpetrators of the rape and then by those responsible for administering justice.”
According to media reports, Aisha pleaded for her life before she was forced into a hole, buried up to her neck and then pelted with stones by some 50 men until she died in front of more than 1,000 people.
UNICEF said that this incident underscores the vulnerability of girls and women in the war-wracked Horn of Africa nation, where it says sexual and gender-based violence is commonplace and gender inequalities persist in access to essential services.
“Authorities and institutions of civil society have a role to play in supporting and protecting the rights of every child,” Mr. Balslev-Olesen said, noting that this killing reflects the great effort that must be undertaken to protect the rights of Somali girls and women.

Tengo una prima detenida en lancaster PA , al parecer iba con su marido y la policia los detuvo, a el lo acusan de vender drogas, ella lo quiso dejar muchas veces pero el la amenazaba con quitarle a los niños ahora ella tambien esta detenida, ellos tienen mas hijos pero no sabemos que paso con los niños, y ella esta a punto de ser mama otra vez, nadie de mi familia puede viajar a EUA pq no tenemos visa, somos mexicanos, sabra de alguna institucion que nos pueda ayudar a saber la situacion real de mi prima y de sus hijos y a ayudarla? de antemano muchas gracias

International Women’s Health Coalition
November 5, 2008, NEW YORK, NY – “From our partners in every country of the world, we are hearing excitement at the election of Barack Obama. To quote one, ‘human rights are back again and every measure to curtail freedoms is now not so popular.’
For many Americans, and the world, the most urgent issues facing President-elect Obama will be the financial crisis and the wars in Iraq and Afghanistan, but we need to put them into perspective. The work that is undertaken before he takes office, his inaugural address, and the early months of a new Administration will need to place U.S. leadership at the forefront of protecting and promoting human rights and equality for all. This will go far in restoring confidence during this difficult time.
Despite—in fact, because of these crises—we hope he will emphasize U.S. government—and the U.S. people’s—commitment to end poverty and injustice worldwide. In our globalized world, it is essential that low- and middle-income countries weather the storm well in order for rich countries to do so. At the heart of our strategy must be foreign assistance for health and education.
Based on 40 years of international work, I know that there will be no global peace or security until we secure every woman’s right to a just and healthy life. Only healthy women whose human rights are protected can be fully productive workers and effective participants in their country’s political processes. Only when women are healthy and empowered can they raise and educate healthy children. These are the building blocks of stable societies and growing economies, and imperative in their own right.
President-elect Obama has the unique opportunity, and the profound responsibility, to reverse harmful international health policies imposed by the U.S. government in the last eight years and to reestablish our credibility and global leadership on human rights for all by:
Promoting the human rights of women at the United Nations and protecting these rights in collaboration with other governments.
Prioritizing U.S. investment in reproductive health services, including care during pregnancy and childbirth, access to contraceptives and safe abortion, and diagnosis and treatment of sexually transmitted infections and HIV/AIDS.
Ensuring access to comprehensive sexuality education that teaches young people how to establish equality in relationships, respect the right to consent in both sex and marriage, and end violence and sexual coercion.
The next Administration has the opportunity and the power to change the future for millions of girls and women, boys and men. It will take courage and vision to act boldly. The reward—in lives saved and in our restored reputation as a global leader for social justice—will be incalculable.”

“De nuestras socias y socios en cada país del mundo estamos enterándonos de la emoción que sienten por el triunfo electoral de Barack Obama. Una de ellas dijo: ‘Los derechos humanos han vuelto y ahora todas las medidas que coartan libertades no son tan populares’.
Muchas personas en Estados Unidos, y en el mundo, consideran que los problemas más urgentes que habrá de afrontar el Presidente electo son la crisis financiera y las guerras en Irak y Afganistán. Sin embargo, es necesario poner estos asuntos en perspectiva. El trabajo que se emprenda antes de que él asuma el cargo, su discurso inaugural y los primeros meses del nuevo gobierno deberán poner el liderazgo estadounidense a la vanguardia de la protección y promoción de los derechos humanos y la igualdad para toda la gente. Ello contribuirá en gran medida a restaurar la confianza durante estos difíciles tiempos.
A pesar de estas crisis—de hecho, precisamente por ellas—esperamos que el Presidente electo haga hincapié en el compromiso del gobierno de Estados Unidos—y del pueblo estadounidense—de poner fin a la pobreza y la injusticia en el planeta. En nuestro mundo globalizado, es esencial que los países de ingresos bajos y medios superen bien la tormenta a fin de que los países ricos también lo hagan. La ayuda externa para salud y educación debe estar en el centro de nuestra estrategia.
Tras 40 años de trabajo internacional, sé que no habrá paz ni seguridad mundial sino hasta que aseguremos el derecho de cada mujer a una vida justa y sana. Sólo las mujeres saludables cuyos derechos humanos son protegidos pueden ser trabajadoras plenamente productivas y participantes eficaces en los procesos políticos de sus países. Sólo cuando las mujeres gozan de salud y están empoderadas pueden criar y educar niñas y niños saludables. Éstas son las piezas fundamentales de las sociedades estables y las economías en crecimiento; también son esenciales por derecho propio.
El Presidente electo Obama tiene la oportunidad única, y la profunda responsabilidad, de revertir las dañinas políticas internacionales impuestas por el gobierno de Estados Unidos en los últimos ocho años y restaurar nuestra credibilidad y liderazgo global en la esfera de los derechos humanos para todas las personas a través de:
· Promover los derechos humanos de las mujeres en las Naciones Unidas y proteger estos derechos en colaboración con otros gobiernos.
· Priorizar la inversión estadounidense en los servicios de salud reproductiva, entre ellos la atención durante el embarazo y el parto, el acceso a anticonceptivos y aborto seguro, así como el diagnóstico y tratamiento de infecciones de transmisión sexual, incluido el VIH/sida.
· Asegurar el acceso a una educación integral sobre la sexualidad que enseñe a las y los jóvenes cómo establecer la igualdad en las relaciones, a respetar el derecho al consentimiento tanto en las relaciones sexuales como en el matrimonio y a poner fin a la violencia y la coerción sexual.
El próximo gobierno tiene la oportunidad y el poder de cambiar el futuro de millones de niñas y mujeres, de niños y hombres. Se requerirá de valentía y visión para actuar con audacia. La recompensa—en vidas salvadas y para nuestra reputación restaurada como líder global en el campo de la justicia social—será incalculable”.

Un millar de castellonenses dicen 'no' en un solo día a la violencia de género
La carpa solidaria contra los malos tratos se instaló en el paseo Morella de Castellón, ayer. El secretario autonómico de Familia y Coordinación Social de la Generalitat, David Calatayud, mostró ayer su satisfacción por el "éxito" de la campaña Yo doy la cara por las mujeres maltratadas después de que, durante el primer día en que permaneció la carpa solidaria en Castellón, mil personas manifestaron su repulsa hacia los malos tratos. Calatayud realizó estas declaraciones durante su visita a la Carpa Solidaria instalada ayer en el paseo de Morella, de Castellón, según informaron en un comunicado fuentes del Consell.
El secretario autonómico explicó que, "para participar en esta campaña, cuyo objetivo es movilizar a la sociedad para luchar contra la violencia que se ejerce sobre las mujeres, es necesario acercarse hasta la carpa solidaria y, una vez ahí, firmar en el muro Punto Final Violencia de Género, ceder su imagen y completar una encuesta de opinión, dejando patente su apoyo a las víctimas de los malos tratos y su compromiso con la lucha para erradicar esta lacra social".

The U.S. Attorney in Manhattan won’t file criminal charges against former New York Gov. Eliot Spitzer for his involvement in a prostitution ring.
The state’s 54th chief executive resigned March 17 amid allegations that he was a client in the Emperors Club VIP. He could have been charged with the Mann Act, which prohibits transporting prostitutes across state lines, but federal prosecutors instead investigated him on questionable financial transactions.
An investigation by the FBI and the IRS’ Criminal Investigation Division determined that Spitzer made payments to bank accounts, one named QAT Consulting, that had been used to launder more than $1 million worth of criminal proceeds derived from the Emperors Club VIP’s prostitution business, according to U.S. Attorney Michael Garcia.
Garcia said Spitzer “acknowledged to this office that he was a client of, and made payments to, the Emperors Club VIP. Our investigation has shown that on multiple occasions, Mr. Spitzer arranged for women to travel from one state to another state to engage in prostitution.”
However, even though the Southern District of New York office announced March 6 that it was filing criminal charges on the structuring scheme, it announced yesterday that there was no evidence of misuse of public or campaign funds.
“We have determined that there is insufficient evidence to bring charges against Spitzer for any offense relating to the withdrawal of funds for, and his payments to, the Emperors Club VIP,” Garcia said. “In light of the policy of the Department of Justice with respect to prostitution offenses and the long-standing practice of this office, as well as Spitzer’s acceptance of responsibility for his conduct, we have concluded that the public interest would not be further advanced by filing criminal charges in this matter.”
A first-term Democrat, Spitzer took office in January 2007 after serving as New York’s attorney general, and was known for his hard-lined approach to fraud and reform.
Former Lt. Gov. David Paterson, who took over as governor after Spitzer’s resignation, has announced he plans to seek re-election.

Violencia obstétrica debe ser incluida en Código Penal

Xalapa, Ver., 6 nov 08 (CIMAC).- La Ley de Acceso de las Mujeres a una Vida Libre de Violencia de Veracruz carece de mecanismos de aplicación, ya que se requiere de la modificación del Código de Penal y de Procedimientos Penales, y aun cuando se han presentado algunas reformas de iniciativas para ambos códigos hasta ahora ninguna ha sido aprobada.
La legisladora Dalia Pérez Castañeda, secretaria de la Comisión de Equidad y Género del Congreso de Veracruz, manifestó que dicha ley, aprobada el 10 de marzo del presente año no se puede aplicar porque primero se requieren reformas a los códigos mencionados.
Por ello, en breve la Comisión de Equidad y Género presentará dictámenes de reformas a los códigos de Procedimientos penales, Civil y a leyes, que servirán de apoyo para lograr que la Ley de Acceso a las Mujeres a una Vida Libre de Violencia sea realmente aplicada para prevenir este fenómeno y a quienes han cometido delitos contra las mujeres, de tal forma que no quede como una ley de adorno.
Dicha Ley tiene por objeto definir y establecer los tipos y modalidades de violencia contra las mujeres y las niñas, para que los gobiernos del estado y municipal realicen las acciones encaminadas a su prevención, atención, sanción y erradicación; atentos a los principios de coordinación y concurrencia gubernamental.
De acuerdo con el periódico Imagen, Pérez Castañeda señaló que de entre los dictámenes que se presentarán, sobretodo en lo que se refiere a salud, sea tipificada en el Código Penal la violencia obstétrica, a fin de que se sancione, aplique alguna multa o sea retirada la cédula a aquel profesional de la medicina que induzca algún método anticonceptivo a las mujeres en contra de su voluntad o que cometa otro tipo de violencia obstétrica.

Young voters and Latinos are being widely credited with helping propel Barack Obama to a commanding victory, but an even greater source of support for the president-elect appears to have come from unmarried women—an important but often overlooked demographic.
Unmarried women—a group that includes single, separated, divorced, or widowed women—voted for Obama over Republican opponent John McCain by a whopping 70 to 29 percent in yesterday's election, according to numbers released today by Women's Voices Women Vote, a nonpartisan organization.
Married women, by contrast, preferred McCain by a slim 3 percentage-point margin, 50 to 47 percent.
Unmarried women have historically voted for Democrats—in 2004, for example, 62 percent chose Sen. John Kerry over President Bush—but Obama's performance easily surpasses that of his predecessors.
Overall, 53 percent of the national electorate this year was female, according to exit poll data. Women overall voted 56 to 43 percent for Obama; men voted 49 to 48 percent for him.

Somalia: La niña lapidada tenía 13 años
Desmintiendo las informaciones aparecidas anteriormente en los medios de comunicación, Amnistía Internacional ha revelado que la niña lapidada hasta la muerte en Somalia esta semana tenía 13 años, no 23.
Aisha Ibrahim Duhulow murió el lunes 27 de octubre a manos de un grupo de 50 hombres que la lapidaron hasta la muerte en el puerto meridional de Kismayo, ante un millar de espectadores.
Varios de los periodistas somalíes que habían informado que tenía 23 años han dicho a Amnistía Internacional que calcularon su edad por su aspecto físico.
Aisha estaba acusada de adulterio según la ley islámica, pero su padre y otras fuentes han dicho a Amnistía Internacional que de hecho había sido violada por tres hombres y, que al intentar denunciar la violación a la milicia Al Shabab que controla Kismayo, fue acusada de adulterio y detenida. Ninguno de los hombres a los que acusó de violación fue detenido.
“No fue un acto de justicia ni una ejecución. Esa niña sufrió una muerte horrible a instancias de los grupos armados de oposición que actualmente controlan Kismayo,” ha dicho David Copeman, adjunto de investigación y acción sobre Somalia de Amnistía Internacional.
Este homicidio es otro abuso contra los derechos humanos cometido por los combatientes en el conflicto de Somalia y demuestra de nuevo la importancia de que la comunidad internacional actúe para investigar y documentar estos abusos a través de una Comisión Internacional de Investigación.”
Según ha sabido Amnistía Internacional:
Ibrahim Duhulow tenía 23 años calculando su edad por su aspecto físico, según uno de los periodistas que informaron sobre la lapidación. Otras fuentes, incluido su padre, confirmaron su edad real a Amnistía Internacional.
El padre de Aisha declaró que la niña estaba en Kismayo desde hacía sólo tres meses, y había venido del campo de refugiados de Hagardeer, en el nordeste de Kenia.
Aisha fue detenida por la milicia de las autoridades de Kismayo, una coalición de la milicia de Al Shabab y milicias de clan. Según los informes, durante el tiempo que permaneció detenida sufrió una gran angustia, y hay personas que afirman que llegó a desvariar.
Para la lapidación llevaron al estadio un camión cargado de piedras.
En un momento de la lapidación, según han confirmado a Amnistía Internacional numerosos testigos, se ordenó a personal sanitario que comprobara si Aisha Ibrahim Duhulow, que estaba enterrada, seguía con vida. La desenterraron, declararon que aún vivía, y volvieron a colocarla en el agujero para continuar con la lapidación.
Según Radio Shabelle, una persona que dijo llamarse Sheik Hayakalah afirmó: “Ella misma aportó las pruebas y confirmó oficialmente que era culpable, diciéndonos que le alegraba recibir el castigo que dispone la ley islámica”. Frente a esta afirmación, varios testigos han dicho a Amnistía Internacional que la muchacha forcejeó con sus captores y tuvo que ser llevada al estadio por la fuerza.
Dentro del estadio, miembros de la milicia abrieron fuego cuando algunos de los testigos del homicidio intentaron salvarle la vida, y mataron a disparos a un niño que presenciaba los hechos. Más tarde, y según los informes, un portavoz de Al Shabab se disculpó por la muerte del chico y afirmó que el miliciano que había disparado sería castigado.
Información complementaria
Amnistía Internacional ha hecho campaña para poner fin al uso de la lapidación, un castigo que considera espeluznante y horrible. El homicidio de Aisha Ibrahim Duhulow demuestra la crueldad y la discriminación contra las mujeres inherentes a este castigo.
Los informes sobre este homicidio deben encuadrarse en el clima de temor que los grupos insurgentes armados como Al Shabab han creado en las zonas que controlan en Somalia. Como ya ha documentado Amnistía Internacional, autoridades, periodistas y defensores de los derechos humanos son amenazados de muerte y se exponen a perder la vida si se considera que han criticado a Al Shabab, milicia que ha hecho una campaña de intimidación contra el pueblo somalí mediante estos homicidios.
Desde la muerte de Aisha Ibrahim Duhulow, varias personas han dicho a Amnistía Internacional que han huido de Kismayo por temor a sufrir su misma suerte.

12 de noviembre: Encuentro Nacional de la Red Chilena contra la Violencia Doméstica y Sexual
Con un gran encuentro nacional concluirán las jornadas de capacitación que la Red Chilena contra la Violencia Doméstica y Sexual ha realizado en 8 regiones del país, donde se abordó la violencia contra las mujeres como un problema político.
Este encuentro, en el que participarán representantes de organizaciones integrantes de la Red, se realizará en el Aula Magna de la Facultad de Derecho de la Universidad Diego Portales, el día 12 de noviembre.
Las jornadas de capacitación que concluyeron en la ciudad de Valdivia, el día 18 de octubre, itineraron por las regiones de: Arica y Parinacota, Atacama, Coquimbo, Valparaíso, Región Metropolitana, Maule, Bío Bío, Araucanía y de los Ríos (que incluyó asistentes de Los Lagos).
Uno de los grandes logros de este proceso fue la articulación de las organizaciones a nivel regional, a través del debate político, la formación y el análisis realizado de la realidad de cada región en cuanto a la violencia contra las mujeres.
El encuentro nacional de la Red, constará de dos días, en que las participantes conocerán una visión general de la legislación sobre femicidio en América Latina, enfatizando en la necesidad de tipificación de este delito. Además, se espera generar un debate para establecer la estrategia nacional de la Red, que contemple el desarrollo de acciones conjuntas y coordinadas.
Además, en este encuentro se contempla el Seminario “Femicidio en Chile: Tipificar para erradicar”, evento abierto a público, que se realizará el día Jueves 13 de noviembre, en la facultad de Derecho de la Universidad Diego Portales. Destacan entre las expositoras, la abogada Patsilí Toledo y la ex-parlamentaria guatemalteca Alba Estela Maldonado, que expondrán sobre la legislación sobre femicidio en América Latina.

Trabajar contra la violencia doméstica
Una oficina que depende de la corte suprema atiende denuncias todos los dias, las 24 horas.

Con apenas 45 días de funcionamiento, la Oficina de Violencia Doméstica de la Corte Suprema ya recibió 750 denuncias. Con atención permanente las 24 horas, los 365 días del año, esta oficina quiere hacer frente a un problema social grave y al mismo tiempo oculto: la violencia entre miembros de la familia o convivientes.
De manera ininterrumpida, varios equipos interdisciplinarios integrados por médicos, psicólogos, asistentes sociales, psiquiatras y abogados trabajan en la oficina, ubicada en Lavalle 1250, de esta Capital.
La iniciativa de la Corte tiene más de dos años: la idea había sido del entonces presidente del tribunal, el juez Enrique Petracchi. Pero el proyecto tuvo sus demoras, y finalmente la oficina quedó inaugurada el 15 de setiembre. Fue otra jueza de la Corte, Elena Highton, vicepresidenta del tribunal y ex camarista civil, la que le dio el impulso final. En la dependencia trabajan ahora 72 personas.
La oficina está a cargo de Analía Monferrer, quien explicó a Mujer que las víctimas de violencia doméstica pueden concurrir a cualquier hora, y no sólo en horario de tribunales, porque este tipo de hechos "no tienen días ni horarios".
"Desde el 15 de setiembre, cuando comenzó a funcionar la oficina, hasta hoy (martes 28) hubo un total del 746 personas que se acercaron a realizar alguna denuncia, tanto las directamente afectadas, o -en algunos casos- mujeres que vinieron a denunciar hechos de violencia contra sus hijos, por parte del marido", comenta Monferrer. "Las personas tiene que tener domicilio en Capital, o al menos el hecho de violencia tiene que haber sido cometido en Capital", aclara.
Del total de denuncias, 637 fueron cometidos contra mujeres, y 109 contra hombres. En éste último caso se encuentran los hechos de violencia de hijos contra sus padres, generalmente personas mayores de edad.
La funcionaria comenta que en la oficina se recibe a la persona denunciante, que es atendida por un abogado, una trabajadora social y un psicólogo, y luego se labra un acta y un informe de riesgo. Algunos casos son asignados por sorteo a un juzgado, y en otros casos -como las lesiones leves- es la persona denunciante la que decide si quiere o no una derivación judicial. Somalia: Girl stoned was a child of 13
Contrary to earlier news reports, the girl stoned to death in Somalia this week was 13, not 23, Amnesty International can reveal.
Aisha Ibrahim Duhulow was killed on Monday, 27 October, by a group of 50 men who stoned her to death in a stadium in the southern port of Kismayu, in front of around 1,000 spectators.
Some of the Somali journalists who had reported she was 23 have told Amnesty International that this age was based upon a judgement of her age from her physical appearance.
She was accused of adultery in breach of Islamic law but, her father and other sources told Amnesty International that she had in fact been raped by three men, and had attempted to report this rape to the al-Shabab militia who control Kismayo, and it was this act that resulted in her being accused of adultery and detained. None of men she accused of rape were arrested.
“This was not justice, nor was it an execution. This child suffered a horrendous death at the behest of the armed opposition groups who currently control Kismayo,” said David Copeman, Amnesty International's Somalia Campaigner.
“This killing is yet another human rights abuse committed by the combatants to the conflict in Somalia, and again demonstrates the importance of international action to investigate and document such abuses, through an International Commission of Inquiry.”
Amnesty International has learned that:
Aisha Ibrahim Duhulow was reported as being 23, based upon a judgement on her physical appearance, according to one of the journalists who had reported the stoning. Her actual age was confirmed to Amnesty International by other sources, including her father.
Her father said she had only travelled to Kismayo from Hagardeer refugee camp in north eastern Kenya three months earlier.
She was detained by militia of the Kismayo authorities, a coalition of Al-shabab and clan militias. During this time, she was reportedly extremely distressed, with some individuals stating she had become mentally unstable.
A truckload of stones was brought into the stadium to be used in the stoning. At one point during the stoning, Amnesty International has been told by numerous eyewitnesses that nurses were instructed to check whether Aisha Ibrahim Duhulow was still alive when buried in the ground. They removed her from the ground, declared that she was, and she was replaced in the hole where she had been buried for the stoning to continue.
An individual calling himself Sheik Hayakalah, was quoted on Radio Shabelle saying:``The evidence came from her side and she officially confirmed her guilt, while she told us that she is happy with the punishment under Islamic law.'' In contradiction to this claim, a number of eye witnesses have told Amnesty International she struggled with her captors and had to be forcibly carried into the stadium.
Inside the stadium, militia members opened fire when some of the witnesses to the killing attempted to save her life, and shot dead a boy who was a bystander. An al-Shabab spokeperson was later reported to have apologized for the death of the child, and said the milita member would be punished.
Background
Amnesty International has campaigned to end the use of the punishment of stoning, calling it gruesome and horrific. This killing of Aisha Ibrahim Duhulow demonstrates the cruelty and the inherent discrimination against women of this punishment.
The reports on this killing should be understood within the climate of fear that armed insurgent groups such as al-Shabab have created within the areas they control in Somalia. As Amnesty International has documented previously, government officials, journalists and human rights defenders face death threats and killing if they are perceived to have spoken against al-Shabab, who have waged a campaign of intimidation against the Somali people through such killings.
Since the death, a number of individuals have told Amnesty International they have fled from Kismayo out of fear of suffering a similar fate to Aisha Ibrahim Duhulow.
